Acceptable use policy

This Acceptable Use Policy (“AUP”) is part of our Terms and conditions. It applies to everyone who uses SmartWA, operated by .

1. What SmartWA is, and what it is not

SmartWA is a technology service. It provides WhatsApp link redirection (smart links) and website analytics. We only redirect links and measure clicks. We do not create, publish, host, sell, advertise or promote any customer’s website, product, service, message or link, we do not run advertising for customers, and we do not endorse anything a customer promotes. We do not see the content of WhatsApp conversations.

Customers are solely responsible for their websites, WhatsApp numbers, messages, offers and the content their links lead to.

2. What is not allowed

You must not use SmartWA, including smart links, the tracking script, the WhatsApp button, forms and any account feature, to direct people to, advertise, promote, or facilitate:

  • Betting, gambling and online money games of any kind: online casinos, sports or cricket betting, satta/matka, lotteries, card or rummy games played for money, fantasy games for money, betting “IDs” and referral, affiliate or “surrogate” promotion of any of these.
  • Adult and sexually explicit content or services: pornography, nudity, escort or sexual services, adult chat or webcam services, and non-consensual intimate imagery.
  • Child sexual abuse material or any sexualisation of minors. This is zero tolerance: we remove it at once and report it to the authorities.
  • Other illegal goods or services: illegal drugs, weapons, counterfeit goods, stolen data, and anything unlawful in India or in the country of the people you are targeting.
  • Fraud and deception: scams, phishing, fake investment or “get rich” schemes, pyramid or Ponzi schemes, unlicensed financial services, impersonation.
  • Hate, violence and terrorism, or content that harasses or threatens people.
  • Spam: unsolicited bulk messaging, or anything that breaks the WhatsApp Business Messaging Policy or other platform rules.
  • Malware, attempts to break or abuse the Service, or hiding the real destination of a link from reviewers (cloaking).

This applies to the website where the script is installed, the WhatsApp number a link opens, the link slug and prefilled message, and the content a visitor reaches, including after the redirect.

3. Your responsibilities

You are responsible for making sure your use is lawful, including the Information Technology Act, 2000 and the Promotion and Regulation of Online Gaming Act, 2025 in India, and the laws of any country you target, and for following WhatsApp’s and Meta’s policies. If you are not sure whether something is allowed, ask us before you use it.

4. How we enforce this

We do not monitor every customer in advance, but we act when we learn of a violation, whether from a report, a court order or a government notice. If we find or reasonably believe this AUP has been broken, we may, without prior notice and without refund:

  • disable the link, the tracking script or the whole account;
  • remove or refuse to serve content or settings that break this policy;
  • keep records and share them with law enforcement or other authorities when the law requires it or when we think it is necessary to prevent harm;
  • refuse future sign-ups from the same person or business.

Repeated or serious violations lead to permanent termination. You agree to be responsible for any loss or claim caused by your breach of this AUP.

5. Report a violation

If you see a SmartWA link or a website using our script for betting, adult content, fraud or anything else described above, please tell us using the abuse report form. Include the link or website address. We review reports promptly.

This policy may change from time to time. Continuing to use SmartWA after a change means you accept the updated policy.
